What are the consequences of not responding to Notice 142(1)?
There are severe
consequences of not complying with the demands of Notice 142(1).
- You may be
charged a penalty of ₹10,000 u/s271(1)(b)
- The Assessing
officer, on the basis of all the relevant information and proofs gathered by
him, will give a “Best Judgement Assessment” u/s 144, which will then be
binding on the Assessee.
- Failure to
provide the necessary documents to the AO in order to carry out his assessment,
within the stipulated time, on any other failure to respond can attract
prosecution of 3 months to 7 years u/s 276CC, depending on the gravity of the
case.
