What are the consequences of not responding to Notice 142(1)?

There are severe consequences of not complying with the demands of Notice 142(1).

  1. You may be charged a penalty of ₹10,000 u/s271(1)(b)
  1. The Assessing officer, on the basis of all the relevant information and proofs gathered by him, will give a “Best Judgement Assessment” u/s 144, which will then be binding on the Assessee.
  1. Failure to provide the necessary documents to the AO in order to carry out his assessment, within the stipulated time, on any other failure to respond can attract prosecution of 3 months to 7 years u/s 276CC, depending on the gravity of the case.
